Complaining about a change to eligibility criteria or another policy

If you have not been reassessed, remind the local authority that they must meet your assessed needs. They cannot stop your support without reassessing you. Ask for a new assessment - see Getting the best out of your assessment.

You may have been refused support because of a blanket policy. Tell them that it is unlawful and that they have a duty to meet your individual needs. If the problem is a change in the eligibility criteria, find out more about how they have done this and complain if it has been unfair.

The local authority has a duty to consult properly. Remind them about this. If they consulted but didn’t do it properly, explain why you think it does not count - see Did they consult properly?

Even if you cannot stop them changing the eligibility criteria, you can highlight the serious consequences for you and ask them to provide you with more support. Local authorities have a duty to consider meeting lower level needs even if they don’t come within the eligibility criteria if meeting them would prevent you getting into crisis.
